Anticipatory Bail

The  legal provision  of  “anticipatory bail,”  under section Section 438 of the Indian Code of Criminal Procedure (CrPC) allows the accused to apply to the court by way of an anticipatory bail application to apply for  bail .Now offences could either be bailable or non bailable and cognizable and non cognizable. As the name itself suggest anticipatory which literally  means in anticipation. The person may be allowed to be released in case of arrest when such a bail is granted by the court.
