Section 69 of BNS

Section 69 of BNS or Bharatiya Nyaya Sanhita  provides up to 10 years’ imprisonment  wherein a person engages in sexual intercourse with a  false promise to marry  which is to say the sexual activity was entered into with a woman by deceit.

Ingredients that need to be satisfied  are whether there was in reality a promise to marry and upon that promise sexual activity was consented to. In other words had there been no promise to marry the woman would not have consented to engaging in sexual activity which essentially means that  the consent was obtained by deceitful means.

Section 69 – Sexual intercourse by employing deceitful means etc.

Whoever, by deceitful means or by making promise to marry a woman without any intention of fulfilling the same, and has sexual intercourse with her, such sexual intercourse not amounting to the offence of rape, shall be punished with imprisonment of either description for a term which may extend to ten years and shall also be liable to fine.

Explanation: “deceitful means” shall include the false promise of employment or promotion, inducement or marring after suppressing identity.
