What is Section 326 IPC-INDIAN PENAL CODE?

Section 326 IPC-INDIAN PENAL CODE is Causing grievous hurt which is akin to causing serious harm or injury  to another personby use of  dangerous weapons may result in  imprisonment for up to ten years along with a fine. Section 326 of the Indian Penal Code (IPC) deals with voluntarily causing grievous hurt by dangerous weapons or means.

“Whoever, except in the case provided for by section 335, voluntarily causes grievous hurt by means of any instrument for shooting, stabbing or cutting, or any instrument which, used as a weapon of offence, is likely to cause death, or by means of fire or any heated substance, or by means of any poison or any corrosive substance, or by means of any explosive substance, or by means of any substance which it is deleterious to the human body to inhale, to swallow, or to receive into the blood, or by means of any animal, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.”

What is Section 335 IPC?

Under Section 335 IPC if  someone causes severe harm (grievous hurt) to another person in response to serious and sudden provocation, however without the intention that there would be such serious harm, they may face imprisonment for up to four years, a fine, or both. This section deals with more of provocation rather than intent ,  and therefore there is provision for lesser punishment compared to cases where grievous hurt is caused without provocation.

Section 335 IPC reads as under-

“Whoever voluntarily causes grievous hurt on grave and sudden provocation, if he neither intends nor knows himself to be likely to cause grievous hurt to any person other than the person who gave the provocation, shall be punished with imprisonment of either description for a term which may extend to four years, or with fine which may extend to two thousand rupees, or with both.”

Whats the difference between Section 326 and Section 335 of the Indian Penal Code (IPC) ?

Both sections deal with grievous hurt but there is a difference in the manner the harm is inflicted.

Conclusion for Section 326 IPC-INDIAN PENAL CODE

Section 326 of the Indian Penal Code (IPC) is more serious than Section 335. Section 326 IPC deals with voluntarily causing grievous hurt by dangerous weapons or means. The punishment under this section can extend to imprisonment for up to ten years along with a fine. On the other hand, Section 335 IPC  , the  punishment under this section is relatively less severe, with imprisonment for up to four years, a fine, or both.  Section 326 IPC is more serious  due to the  fact that the use of dangerous weapons or means, and it carries a much higher  punishment compared to Section 335 IPC.
